Terms of Service

Version … · Effective date: [to be provided by the owner]

Owner-prepared draft. This document is written in plain language, is not certified legal advice, and should be reviewed by qualified legal counsel before paid launch.

These Terms are an agreement between you and [to be provided by the owner] ("we", "us") for your use of FollowUp Launchpad (the "Service"). By creating an account you agree to these Terms and our Privacy Policy.

1. What the Service does — and does not do

FollowUp Launchpad is a blueprint and setup tool. It helps you write prompts, instructions, and setup checklists for AI assistants that you build and run yourself on third-party AI platforms. We do not operate, host, monitor, or control your assistants. We do not connect to, read, or send from your email, CRM, files, or AI accounts, and we never send messages on your behalf.

2. Third-party AI platforms

ChatGPT, Microsoft 365 Copilot, Claude, Gemini, and any other platform you use are independent services that we do not own or control. Their features, pricing, limits, and terms are set by their providers and may change, be restricted, or become unavailable at any time. We are not responsible for their outages, changes, or decisions.

3. Your responsibilities

4. Acceptable use

You may not use the Service for unlawful, deceptive, harassing, or abusive purposes. See the Acceptable Use Policy.

5. AI accuracy and no guarantees

Blueprints are produced with the help of AI and templates and may contain errors, omissions, or outdated platform instructions. Setup guidance is provided as-is and may not match your platform version or plan. We do not guarantee any sales, revenue, response rates, or agent performance, or that a follow-up will never be missed. Nothing in the Service is legal advice or a guarantee of legal compliance.

6. Subscriptions, beta, cancellation and refunds

The invitation-only beta is free for 7 days, requires no payment method, and never converts to a paid plan automatically. Paid plans, when offered, renew automatically until canceled, and you can cancel at any time in Billing. Details are in the Billing and Cancellation Policy, which forms part of these Terms.

7. Your data

Your blueprints and business profile belong to you. You can export your data and delete your account from Settings at any time. After your beta or subscription ends, you keep read and export access to blueprints you already saved. How we handle data is described in the Privacy Policy.

8. Changes to the Service

We may change, suspend, or discontinue features or the Service. If we discontinue the Service, we will try to give reasonable advance notice and an opportunity to export your data, and will handle any prepaid amounts as described in the Billing Policy.

9. Disclaimer of warranties

To the extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow these exclusions, so some may not apply to you.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, and our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim (or US $50 if you paid nothing). These limits do not apply where the law does not allow them — for example, liability for fraud, gross negligence, willful misconduct, or personal injury caused by our negligence — and nothing in these Terms limits rights you have under consumer-protection laws that cannot be waived.

11. Indemnification

To the extent permitted by law, you agree to defend and indemnify us against third-party claims arising from communications you send, your violation of law, or your breach of these Terms, except to the extent the claim is caused by our own wrongdoing.

12. Disputes

If you have a concern, please contact us first via the Contact page so we can try to resolve it informally within 30 days. If it is not resolved, either party may pursue the remedies available under applicable law in the courts of [to be provided by the owner], unless local law gives you the right to bring a claim elsewhere. These Terms are governed by the laws of [to be provided by the owner]. Nothing here waives any right you cannot lawfully waive.

13. Changes to these Terms

We may update these Terms. Material changes will be posted with a new version number, and where required we will ask you to accept them again.
